This notice describes how your health information may be used and shared and how you can get access to this information. Please review it carefully.

When Manny helps you choose a Medicare plan, he sometimes sees information that counts as “Protected Health Information” under the federal HIPAA law — like your Medicare number, the medications you take, or which doctors you see. He treats that information as confidential, only uses it to help you, and never sells it.

1. Who this notice applies to

Under HIPAA, a Medicare Advantage organization, Part D sponsor, or other health plan is the “covered entity.” When Manny Leon, doing business as MannyMedicare.com, assists you with plan selection and enrollment, he typically functions as a business associate of the carrier whose plan you choose, and is bound by HIPAA’s privacy and security rules with respect to your Protected Health Information (“PHI”).

This notice describes how Manny uses and discloses your PHI and your rights with respect to that information.

2. What we mean by “PHI”

PHI is individually identifiable information that relates to your past, present, or future physical or mental health, the care you receive, or how that care is paid for. Examples we may handle:

  • Your Medicare claim number (HICN / MBI);
  • Health-plan member ID and group number;
  • Dates of birth, addresses, phone numbers tied to your health coverage;
  • Prescription drug lists (for a Part D / formulary check);
  • Names of your doctors, hospitals, and pharmacies;
  • Health conditions disclosed during a Scope of Appointment or enrollment call.

3. How we may use and disclose your PHI

3.1 For treatment, payment, and operations of the plan

We may share your PHI with a Medicare Advantage, Part D, or Medicare Supplement carrier so they can issue your policy, pay claims, coordinate care, or run their health plan. We may also share PHI with a successor agent if you ask us to transfer your account.

3.2 To help you choose a plan

We use your PHI to look up doctor networks, prescription costs, plan benefits, and enrollment eligibility. We may run your prescriptions through the carrier’s formulary tool to estimate your out-of-pocket cost.

3.3 As required by law

We may disclose PHI when federal or Florida law requires us to — for example, to respond to a subpoena, a CMS audit, a Florida Department of Financial Services request, or a public-health authority.

3.4 With your written authorization

Any other use or disclosure of your PHI requires your written authorization. You can revoke that authorization at any time, in writing, by emailing quote@mannymedicare.com.

3.5 We never sell your PHI

We do not sell PHI. We do not use PHI for marketing on behalf of a third party. We do not send PHI to a lead-aggregation network.

4. Your rights

Under HIPAA, you have the right to:

  • Inspect and copy the PHI we maintain about you. We may charge a reasonable fee for paper or electronic copies.
  • Request a correction if you believe information we hold is wrong or incomplete. We may deny the request in limited circumstances, but you can file a written disagreement.
  • Receive an accounting of disclosures we have made of your PHI for the past six years (excluding certain routine disclosures).
  • Request a restriction on how we use or disclose your PHI for treatment, payment, or operations. We are not required to agree to every restriction, but if we do, we will follow it.
  • Request confidential communications — for example, asking Manny to call only your cell phone, not a home phone.
  • Be notified if a breach of unsecured PHI affects you.
  • Receive a paper copy of this notice, even if you have agreed to receive it electronically.

5. Our duties

We are required by law to maintain the privacy and security of your PHI, to provide you this notice of our legal duties and privacy practices, to follow the terms of the notice currently in effect, and to notify you in the event of a breach of unsecured PHI.

6. Changes to this notice

We may change this notice and apply the updated terms to PHI we already hold. The current notice will always be posted on this page with an updated revision date. If you are an active client, we will also offer you a paper copy of any updated notice on request.

7. Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services. There will be no retaliation for filing a complaint.
